Sheriff's Year-End Review, Final Medical Marijuana Vote at Wednesday City Council Meeting

Medical marijuana dispensaries, yearly Sheriffs crime report and the Seacoast Inn hotel update are on Wednesday's council agenda.

After a boisterous June 15 public hearing, a final decision will be made Wednesday evening to adopt two ordinances to prohibit opening any medical marijuana distribution facilities in the city and definitions for medical marijuana use, supply and cultivation for medical marijuana patients and caregivers.

"The City shall not issue, approve or grant any permit, license, or other entitlement of the establishment or operation of a medical marijuana distribution facility in the City of Imperial Beach."

Sent back to staff for evaluation, the two ordinances do not ban medical marijuana in the city. It gives qualified patients and caregivers the ability to possess, cultivate and use medical marijuana under state law.

Amendment changes defines a prohibited marijuana distribution facility applies when marijuana is supplied to or cooperatively cultivated by four or more persons.

Staff recommends adoption of both ordinances, then request final approval from the California Coastal Commission. This is agenda item 3.1.

A staff presentation of "Imperial Beach-The Big Picture," update includes projects initiated, completed and discussion of envisioned projects. Adopted in October 2000, this document is used as a guiding plan for planning and redevelopment activities. This is agenda item 6.3.

The Imperial Beach Sheriff Department delivers its Year-end Review showing a dramatic decrease in crime rates in the city for robbery, aggravated assault, burglary, theft and auto theft. In 2009-10, the Sherriff Department shows an eight percent increase in DUI arrest and a 63 percent increase in narcotic-related arrest. The report indicated not an increase in crime, but the result of increased law enforcement activities. This is agenda item 6.4.

Agenda Item 6.5 is an update on Tijuana River Watershed. A council nomination of a new Imperial Beach representative to serve a three-year term on the Port of San Diego's Public Art Committee. (Agenda Item 6.6) And designation of voting delegate and alternate for League of California Cities Annual Conference, September 21-23, 2011. This is agenda item 6.7.

Total city expenditures up for ratification by council for $1,308,938.25.

May 2011 Imperial Beach Law Enforcement Services total $452,970.03 and city payroll, $370,750.84 for pay periods ending June 2, and June 16, 2011. This is agenda item 2.1.

Council will hear its monthly update on the status and progress of the redevelopment of the Seacoast Inn Hotel from Pacifica Companies Project Manager Allison Rolfe. This is agenda item 6.1.

Bikeway Village has two alternatives up for review of 13th Street right-of-way proposals, including bike path, sidewalk, traveled way and parking. Alternative A provides diagonal parking, combined bicycle/vehicle path and easterly sidewalk. Alternative One proposes use of parallel parking, a Class II Bikeway and easterly sidewalk. This is agenda item 6.2.

Expired in 2005, the Imperial Beach Women's Club is asking for a retroactive extension of a 25-year contract for use of the Marina Vista Community Center in Veterans Park to October 2030. In agreement with the City Manager, the club agrees to make the following modifications to the community center: construct a storage room, re-landscape area south of the center (including sprinkler system re-installation), new fire retardant drapes, repaint interior and install new acoustical ceiling and lighting in the south activity room. This is agenda item 2.2.

Still under review, Kamal Nona, owner and Nick Aljabi, architect, are requesting a six-month extension for a Conditional Use Permit for two mixed use developments with two retail commercial units and two residential units on 13th Street. This project was delayed due to circumstances related to the site plan and parking issues. The approved site plan attached and construction expected within 30 days of obtaining building permits. This is agenda item 2.3.
