Family of Woman Killed by Border Patrol Files Lawsuit

The family of Valeria Tachaquin Alvarado have filed a federal lawsuit following the shooting death of the mother of five last fall, claiming excessive force and wrongful death, CBS8 reported Tuesday.

Border Patrol agents were serving a warrant at a home in west Chula Vista in September 2012 when Alvarado allegedly attempted to flee in a car. 

Last fall the Border Patrol said Alvarado tried to run over an agent in her attempt to flee.

Eyewitnesses said Alvarado's actions were not threatening the agent when shots were fired, said attorney Eugene Iredale, who is representing the family.

An investigation by the Chula Vista Police Department and Department of Homeland Security Office of the Inspector General is ongoing, the Border Patrol said in a statement Tuesday.
